ಬೆಂಗಳೂರು (ಜ.19): ಸುಳ್ಳು ಜಾತಿ ಪ್ರಮಾಣ ಪತ್ರ ಸಲ್ಲಿಸಿ 2013ರ ವಿಧಾನಸಭಾ ಚುನಾವಣೆಯಲ್ಲಿ ಮುಳಬಾಗಿಲು ಕ್ಷೇತ್ರದಿಂದ ಆಯ್ಕೆಯಾಗುವ ಮೂಲಕ ಪರಿಶಿಷ್ಟ ಜಾತಿಗಳ ವರ್ಗಕ್ಕೆ ವಂಚಿಸಿರುವ ಜಿ.ಮಂಜುನಾಥ್ (ಕೋಲಾರದ ಹಾಲಿ ಕಾಂಗ್ರೆಸ್‌ ಶಾಸಕ) ವಿರುದ್ಧ ಕ್ರಮ ಕೈಗೊಳ್ಳುವಂತೆ ಹೈಕೋರ್ಟ್ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ನಿರ್ದೇಶಿಸಿದೆ. ಜಿಲ್ಲಾಧಿಕಾರಿಗಳ ನೇತೃತ್ವದ ಜಾತಿ ಪರಿಶೀಲನಾ ಸಮಿತಿಯು 2021ರ ಅ.27ರಂದು ಕೈಗೊಂಡಿದ್ದ ನಿರ್ಣಯ ಪ್ರಶ್ನಿಸಿ ಜಿ.ಮಂಜುನಾಥ್ ಸಲ್ಲಿಸಿದ್ದ ತಕರಾರು ಅರ್ಜಿ ವಿಚಾರಣೆ ನಡೆಸಿದ್ದ ನ್ಯಾಯಮೂರ್ತಿ ಎಂ.ನಾಗಪ್ರಸನ್ನ ಅವರ ನ್ಯಾಯಪೀಠ, ಅರ್ಜಿಯನ್ನು ತಿರಸ್ಕರಿಸಿದೆ.

ಸುಳ್ಳು ಜಾತಿ ಪ್ರಮಾಣ ಪತ್ರ ಸಲ್ಲಿಸುವ ಮೂಲಕ ಪರಿಶಿಷ್ಟ ಜಾತಿಗೆ ಮೀಸಲಿಟ್ಟಿದ್ದ ಕ್ಷೇತ್ರವನ್ನು ಅರ್ಜಿದಾರ ಜಿ.ಮಂಜುನಾಥ್‌ ಕಸಿದುಕೊಂಡಿದ್ದಾರೆ. ಇದು ಸಂವಿಧಾನದ ನಿಯಮಗಳಿಗೆ ಎಸಗಿದ ಮೋಸವಾಗಿದೆ. ಪರಿಶಿಷ್ಟ ಜಾತಿಗಳಿಗೆ ಮಾಡಿರುವ ವಂಚನೆಯಾಗಿದೆ. ಹಾಗಾಗಿ, ಅವರ ವಿರುದ್ಧ ಸರ್ಕಾರ ಕೈಗೊಳ್ಳಬೇಕು. ಆದರೆ, ಯಾವ ಕ್ರಮ ಜರುಗಿಸಬೇಕು ಎಂಬುದು ಸರ್ಕಾರಕ್ಕೆ ಬಿಟ್ಟಿರುತ್ತದೆ ಎಂದು ನ್ಯಾಯಪೀಠ ಸ್ಪಷ್ಟಪಡಿಸಿದೆ.

ಪ್ರಕರಣದ ವಿವರ: ತಾವು ಪರಿಶಿಷ್ಟ ಜಾತಿಗಳ ಪಟ್ಟಿಗೆ ಬರುವ ಬುಡುಗ ಜಂಗಮ ಜಾತಿಗೆ ಸೇರಿದವರೆಂದು ಘೋಷಿಸಿಕೊಂಡು ಜಿ.ಮಂಜುನಾಥ್ ಅವರು 2013ರಲ್ಲಿ ಮುಳಬಾಗಿಲು ಮೀಸಲು ಕ್ಷೇತ್ರದಿಂದ ಸ್ವತಂತ್ರ ಅಭ್ಯರ್ಥಿಯಾಗಿ ಸ್ಪರ್ಧಿಸಿ ಗೆದ್ದಿದ್ದರು. ಜೆಡಿಎಸ್ ಪರಾಜಿತ ಅಭ್ಯರ್ಥಿ ಮುನಿನಂಜಪ್ಪ ಜಾತಿ ಪ್ರಮಾಣದ ಸಿಂಧುತ್ವ ಪ್ರಶ್ನಿಸಿದ್ದರು. ಪರಿಶಿಷ್ಟ ಜಾತಿಗೆ ಸೇರಿರುವುದನ್ನು ಸಾಬೀತುಪಡಿಸಲು ವಿಫಲರಾದ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಅವರ ಆಯ್ಕೆಯನ್ನು ಹೈಕೋರ್ಟ್‌ 2018ರ ಏಪ್ರಿಲ್‌ನಲ್ಲಿ ಅಸಿಂಧುಗೊಳಿಸಿತ್ತು. ಆ ತೀರ್ಪಿನ ವಿರುದ್ಧ ಅವರು ಸುಪ್ರೀಂಕೋರ್ಟ್ ಮೆಟ್ಟಿಲೇರಿದ್ದರು. ಆ ಅರ್ಜಿ ವಜಾಗೊಳಿಸಿದ್ದ ಸುಪ್ರೀಂಕೋರ್ಟ್, ಜಿಲ್ಲಾಧಿಕಾರಿಗಳ ನೇತೃತ್ವದ ಜಾತಿ ಪರಿಶೀಲನೆ ಸಮಿತಿ ಜಿ.ಮಂಜುನಾಥ್‌ ಅವರ ಜಾತಿಯನ್ನು ಪರಿಶೀಲಿಸಬೇಕು. ಸಮಿತಿಯ ನಿರ್ಣಯದ ಬಗ್ಗೆ ಆಕ್ಷೇಪವಿದ್ದರೆ ಪುನಃ ಅದನ್ನು ಹೈಕೋರ್ಟ್‌ನಲ್ಲಿ ಪ್ರಶ್ನಿಸಬಹುದು ಎಂದು ಆದೇಶಿಸಿತ್ತು. ಜಿ.ಮಂಜುನಾಥ್ ಅವರು ಬುಡುಗ ಜಂಗಮ ಜಾತಿಗೆ ಸೇರಿಲ್ಲ. ಅವರು ಬೈರಾಗಿ ಜಾತಿಗೆ ಸೇರಿದವರು ಎಂದು ಜಿಲ್ಲಾಧಿಕಾರಿಗಳ ನೇತೃತ್ವದ ಜಾತಿ ಪರಿಶೀಲನಾ ಸಮಿತಿ ನಿರ್ಣಯ ಕೈಗೊಂಡಿತ್ತು. ಬುಡುಗ ಜಂಗಮ ಪರಿಶಿಷ್ಟ ಜಾತಿಯಾದರೆ, ಬೈರಾಗಿ ಒಬಿಸಿ ಪ್ರವರ್ಗ-1ಕ್ಕೆ ಸೇರುತ್ತದೆ. ಸಮಿತಿಯ ನಿರ್ಣಯವನ್ನು ಮಂಜುನಾಥ್ ಹೈಕೋರ್ಟ್‌ನಲ್ಲಿ ಪ್ರಶ್ನಿಸಿದ್ದರು. ಇದೀಗ ಹೈಕೋರ್ಟ್ ಶಾಸಕ ಮಂಜುನಾಥ್‌ ಅರ್ಜಿಯನ್ನು ತಿರಸ್ಕರಿಸಿದ್ದು, ಅವರ ವಿರುದ್ಧ ಕ್ರಮ ಜರುಗಿಸಲು ಸರ್ಕಾರಕ್ಕೆ ಸೂಚಿಸಿದೆ.

The Karnataka High Court has rejected a petition by former Mulbagal MLA G Manjunath against a 2021 report of the District Caste Verification Committee (DCVC) that declared his 2012-issued caste certificate invalid. The order was passed on December 20 by a bench comprising Justice M Nagaprasanna who left it to the state to take further action against the petitioner.

The 2021 report in question stated that Manjunath did not belong to the Budaga Jangama community (classified as Scheduled Caste) but to the Byragi community (OBC). His election as an Independent MLA from Mulbagal had been set aside on these grounds.

The bench observed, “the DCVC holds that there are no documents produced by the petitioner to demonstrate that he belongs to Budaga Jangama caste. It also considered the evidence let in by several relatives of the petitioner, inspected school records and has rejected the claim that the petitioner belongs to Budaga Jangama caste on the ground that the customs, food habits and the dress that they wear or the marriage and death ceremonies that they undertake are not akin to what Budaga Jangama community people would undertake. Therefore, no fault can be found with the reasons rendered by the DCVC.”

The bench added, “Except the one that is allegedly issued on 3-04-2012 in favour of the petitioner, there is no other document produced by the petitioner to depict him to be belonging to Budaga Jangama – Scheduled Caste. It is clear case that the petitioner contested the election on a caste certificate, which was on the face of it false and became a law maker even, by stealing away a constituency that was meant for a person genuinely belonging to a scheduled caste. It is this act that fringes on the borders of fraud on the Constitution.”

Dismissing the petition, the court left it to the state to take further action against the petitioner in accordance with the law.
